Water Governance Training Course
What is “Water Governance”?
Water Governance refers to the political, social, economic, legislative and administrative systems in place that influence the use and management of water.
South Africa, a water scarce country, has a law and policy framework for water which is regarded as among the most progressive worldwide. Our water-related law is based upon the constitutional recognition of the right of access to water and the right to an environment that is not harmful to health and well-being, and ensures prevention of pollution and sustainable use of natural resources.
Course Objectives
This three-day course has been designed to facilitate understanding of the principles of Water Governance from a Human Rights perspective, and covers international water governance approaches, sustainable water resource management initiatives, and the implementation of measures in South Africa through statutes such as the National Environmental Management Act (NEMA), the National Water Act (NWA), the Water Services Act (WSA), the NEM: Waste Act, the NEM: Integrated Coastal Management Act (ICMA), and the Promotion of Administrative Justice Act (PAJA), the relevant regulations made under these laws, as well as their respective requirements for authorisation. It furthermore focusses on facilitating understanding of water use authorisation and the circumstances under which a water use license (WUL) is required, as well as of the process to apply for (and amend) a WUL. Practical aspects associated with the substantive and procedural issues around WULs, as currently described in regulations, procedures and guidelines of the Department of Water and Sanitation (DWS), including the preparation of specific documents such as Integrated Water and Waste Management Plans (IWWMPs), and regulatory requirements for water quantity and quality monitoring, as well as the auditing of compliance with WUL-conditions, and the amendment of an incorrect WUL, are also addressed.
The course-content has been completely revised in 2019 to address the aspects contained in the new Regulations regarding the Procedural Requirements for Water Use License Applications (WULAs) and Appeals (GN R267 of March 2017) as well as the new NEM:ICMA Regulations for Coastal Waters Discharge Permits (GN 382 of 15 March 2019).
PLEASE NOTE: If you have previously attended this Course, and would like a refresher to get acquainted with the requirements of these new Regulations, you can attend only the THIRD day of the course, when we will discuss them.
Who should attend this course?
The course is designed for professionals in management and planning in the public and private sectors, who wish to improve their understanding of Water Governance Principles and Concepts, and Water Use Authorisations; and who want to discuss practical solutions for the day-to-day challenges they experience with water governance issues such as WUL-applications.
Specific Outcomes and Key Benefits
Upon completion of the Course, the attendant will be able to –
- understand the need for judicious Water Governance from a Human Rights perspective, and the different concepts and principles underpinning, as well as the tools for, Water Governance;
- grasp the concepts and principles underpinning international initiatives for Sustainable IWRM in the context of Integrated Environmental Management and the Sustainable Development Goals;
- demonstrate awareness of governance mechanisms for water-related issues in South Africa, including duties and liabilities associated with potential pollution impacts on water resources, as well as water governance mechanisms under the NWA, WSA, NEM:WA, and NEM:ICMA, in the context of the PAJA;
- understand the requirements of the NWA, and be able to explain specific aspects, including:
- implications of the NWRS;
- the role and responsibilities of institutions such as CMAs and WUAs;
- resource directed measures and source directed controls;
- Dam Safety requirements; and
- Types of water servitudes.
- grasp the complexities of the legal requirements for water use authorisation, especially with regard to the following:
- Types of Water Uses;
- Tiers of Water Use Authorisations (i.e. ” Do I need a Water Use License?” );
- Procedural and Substantive aspects of Water Use License Applications (WULAs); and
- Considerations for evaluating WULAs– section 27 of the NWA;
- prepare a WULA and IWWMP that addresses the requirements of the new Regulations promulgated by the DWS;
- appreciate the regulatory aspects of water quantity and quality monitoring and be able to correctly evaluate water monitoring data and results from a regulatory perspective; and
- comprehend the process, role and importance of the auditing of compliance with the conditions of a WUL, and WUL Amendment processes.
Practical discussions and exercises aimed at grasping the concepts and topics under discussion will be conducted in a group situation.
Course Certificate and CPD-points
An Assessment will be conducted upon conclusion of the course to ensure quality, and a Certificate of Attendance which can be used to claim THREE (3) CPD-points from WISA, SACNASP and ECSA will be awarded to successful learners.
Entrance Requirements
A Grade 12 certificate as a minimum and preferably also:
- some tertiary education in at least one of the fields of environmental management; OR
- some prior learning in general environmental management and environmental issues; OR
- some relevant activities and responsibilities in at least one of the fields of environmental management.
